Article 213.4 of Federal Law No. 127-FZ does not establish a universal mandatory form called a “bankruptcy certificate”. It requires evidence of the debt, its basis and inability to repay in full, alongside other listed attachments. The substance of the evidence matters more than the marketing name of a bank’s document package.
How much is owed and under which obligation.
Which payments were received and how the balance changed.
The agreement, court order, assignment or other basis of the claim.
Debt certificate, account statement and credit report
| Document | What it shows | What it does not replace |
|---|---|---|
| Debt certificate or calculation | Outstanding obligation and its components on the calculation date | The contract and transaction history over a longer period |
| Account statement | Transactions, incoming payments, debits and balances | A complete creditor list or legal assessment of the calculation |
| Credit bureau report | Information supplied by credit-history sources | Every private, tax or other liability |
| Court order and enforcement document | The adjudicated claim and basis for enforcement | An automatically current balance after later payments |
| Individual’s creditor list | A consolidated schedule prepared by the applicant | Supporting records for each claim |
For a court filing, Article 213.4 requires bank information about accounts, deposits and balances, transaction statements covering the three years preceding filing, and relevant electronic-money and digital-rouble records where applicable. Asking only for the outstanding loan balance does not cover this package.
For MFC bankruptcy, assess Article 223.2 eligibility and the list of all known creditors separately. Do not impose the court’s bank-statement package as a universal additional MFC requirement. The detailed creditor-list guide explains how to transfer the information into the appropriate fields.
How to obtain a bank debt certificate
- Identify the agreements. State loan, card and account numbers and dates. If details are missing, ask the bank to identify current obligations after verifying your identity.
- Specify the date. Request the balance on a chosen date, with separate breakdowns of debt, arrears, interest and penalties.
- Use a traceable channel. Use an authorised online account, branch or written request with delivery evidence. Do not send passport information to unverified addresses.
- Keep the request and response. Retain the registration number, date, request copy and an identifiable written response, rather than only an employee’s verbal answer.
Article 10 of Federal Law No. 353-FZ entitles a consumer borrower to request current debt information and the payment information covered by that provision free of charge once a month. This is a right to information: it does not mean that every additional archive package or repeated certificate in a chosen format is always free. If a fee is requested, establish precisely what service it covers and why the basic information is not supplied free.
Sample wording for a bank request
This is a starting point, not an officially prescribed form. Fill the gaps and adapt the document list to the agreements. Business obligations should not automatically be treated as consumer credit under Law No. 353-FZ. Use the appropriate Russian wording when submitting a request to a Russian bank.
To [bank name]
From [full name and information needed to identify the customer]
Reply channel/address: [details]
Please provide information under Article 10 of Federal Law No. 353-FZ about the current balance under consumer credit agreement No. [number] dated [date], as of [date], and the dates and amounts of payments made and payments due.
For reconciliation, please separately identify principal, accrued interest, the overdue portion, penalties and other charges, together with payments included in the calculation. If the claim has been assigned, please identify the current creditor and the documents evidencing the transfer.
Please also provide [precise list of account certificates and statements, with the relevant period]. These documents are needed to prepare a bankruptcy petition. If a requested document cannot be provided, please give a reasoned response explaining why and how the information can be obtained.
[Date and signature where required by the submission method]
If the account is closed, specify the transaction period and the closing date if known. Where a representative applies, the bank may verify identity and authority; an ordinary letter from an acquaintance does not establish valid representation.
How to check the certificate
- Borrower and agreement: check for an incorrect number, date or omitted agreement.
- Creditor: reconcile its name with assignment or succession documents.
- Calculation date: confirm that recent payments and charges are included.
- Components: distinguish principal and interest from penalties and other charges.
- Verifiability: retain the calculation, relevant period, payment details and evidence of the document’s origin.
A bank-issued certificate is not immune from challenge. If a payment is missing or a charge disputed, identify the discrepancy in writing and attach evidence. A dispute about part of the amount does not justify concealing the underlying obligation from the list or explanations.
If the bank does not provide the documents
First distinguish a refusal from a request for identification or a request that needs clarification. Confirm the details, timing and delivery method and retain the written reason for refusal. The general response period for a financial institution is 15 working days from registration, unless a special statutory rule provides otherwise. In permitted circumstances it can be extended by no more than 10 working days. This is not a universal production deadline for every certificate.
If the issue remains unresolved, consider a complaint to the Bank of Russia with the request, receipt evidence and the bank’s reply. The regulator does not replace the court or determine a disputed contractual balance. In pending bankruptcy proceedings, assess a motion to obtain specific evidence under Article 66 of the Commercial Procedure Code: identify the documents, what they prove, who holds them and why you could not obtain them yourself.
If the court has left the petition without movement pending correction, do not simply await the bank’s reply while ignoring the court’s deadline. Submit available records, evidence of requests and a reasoned procedural application. Sending a request alone does not guarantee an extension or acceptance of an incomplete package.
Frequently asked questions
How long is a bankruptcy debt certificate valid?
Article 213.4 does not impose a universal 30-day validity period on every debt certificate. Consider the filing date, changes in the balance and the court’s specific directions. MFC certificates and evidence of individual-entrepreneur status have their own rules.
Is a banking-app screenshot enough?
It may help explain the situation but often lacks the agreement, breakdown and evidence of origin. Request a downloadable document or formal response; the court evaluates the sufficiency of evidence.
Whom should I contact if the loan was sold?
Verify the notice and assignment records. Ask the current creditor for an up-to-date calculation; the former bank may hold the agreement and payment history from before the transfer.
Can I file without one certificate?
That depends on the available evidence and procedural circumstances. There is no general exemption from attachment requirements: explain the missing record, evidence your attempts to obtain it and use the available procedural routes.
