Core functions
| Function | Practical meaning | Limit |
|---|---|---|
| Membership and standards | Eligibility review and binding professional rules | The SRO does not appoint the administrator instead of the court |
| Supervision | Review of alleged breaches and disciplinary procedure | The SRO cannot reverse court orders |
| Disclosure | Statutory publication of structure, members and rules | The public scope follows the statute |
| Compensation fund | A special payment source under Article 25.1 | Not a general guarantee for every alleged loss |
| Candidate information | Participation in appointment under statutory requests and rules | The court makes the appointment |
How to verify an SRO and administrator
- Find the full name and registration number in the state register.
- Check that the organisation has not been removed and its details match.
- Find the member and current status on the SRO website.
- Compare the data with Federal Register notices and the appointment order.
- Review standards, complaint procedure and disciplinary contacts.
- Save dated extracts and pages.
Role in an insolvency case
The SRO supplies information or a candidate where Law No. 127-FZ requires, supervises compliance and may apply to the court on special grounds. The administrator’s procedural authority, however, arises from the court order rather than membership alone.
For personal insolvency, the appointment route is explained separately in the guide to choosing a financial administrator. This page focuses on the organisation, registers and supervision.
Submitting a report to the SRO
A useful submission identifies the case and administrator, exact conduct, dates, the breached rule and attachments. Discipline does not replace court relief where a party seeks an illegality finding, removal or damages.
Frequently asked questions
Can a person select a particular administrator through the SRO?
The arbitrazh court appoints under the statutory procedure; the SRO’s role depends on the case and request.
Is an SRO a state authority?
No. It is a non-profit organisation with special status and state supervision.
Where is current status checked?
Use the state register and official SRO resources, then the court order in the case.
Will an SRO complaint remove the administrator?
Not automatically. Removal is ordered by the arbitrazh court on a statutory ground.
Does the fund cover every loss?
No. Article 25.1 imposes conditions and document requirements.
