Including a House Share in an Estate in Russia

Where a share in a house or other property is not reflected clearly in the inheritance file, the issue may involve title documents, the composition of the estate and the limits of a notary’s powers. A court route is not automatic: first establish what the deceased owned and which document is missing or disputed.

Acceptance of inheritance

To acquire inheritance, an heir must accept it. As a general rule, acceptance may be made within six months from the opening of the inheritance. Acceptance of part of the inheritance means acceptance of all inheritance due to that heir on the same basis, subject to the statutory rules.

Why a notary may refuse

A notary issues inheritance documents within the evidence available in the inheritance file. If title to a share, its boundaries or the estate’s composition cannot be confirmed by the required documents, the matter may require additional records or a judicial determination rather than a notarial correction.

Documents to review

  • death certificate and documents establishing the heir’s entitlement;
  • title, registration and cadastral records for the house or share;
  • prior purchase, gift, privatization or inheritance documents;
  • the notary’s written decision or explanation;
  • evidence of acceptance and possession where relevant.

Missed deadlines and court protection

An heir who missed the statutory period may seek restoration in court in the circumstances provided by law, subject to the applicable conditions and time limit. The factual basis and requested remedy must be matched carefully.
