EGRN Extract for Personal Bankruptcy: Type, Period and Scope

▦ Real estate · documents · personal bankruptcy

When checking an individual’s real estate for Russian bankruptcy, the relevant document will often be an EGRN extract on an individual’s rights to property previously or currently held. An extract for a single apartment answers a different question. Before ordering, confirm three parameters: the rights required, the period and the territory covered.

Article 213.4 of the Insolvency Law requires an asset inventory and documents concerning rights and specified transactions. It does not make every document labelled an “EGRN certificate” interchangeable. Match the court’s request or your case-document list to the selected extract’s actual content.

An extract about a person or a property?

DocumentQuestion it addressesWhat it does not replace
An individual’s rights to property previously or currently heldWhich registered rights the person holds or held within the selected scopeContracts, payment records and explanations of discrepancies
Principal characteristics and registered rights concerning a propertyInformation about one apartment, land plot or other propertyA search for all properties associated with the person
Transfers of rights concerning a propertyThe registered-rights history of a particular propertyAn overall list of the individual’s real estate

When preparing the asset inventory, first establish the necessary scope of information about the individual, then obtain additional documents for particular properties where needed. Several extracts for known apartments do not by themselves establish a complete list of land plots, garages or ownership shares.

Three settings that change the result

◷ Period

Current rights only, a specific date and a date range are different request options.

⌖ Territory

One Russian region, several regions or the entire Russian Federation.

▤ Property types

A particular property category or all types where comprehensive coverage is needed.

Paragraph 64 of the procedure under Rosreestr Order No. P/0149 allows the applicant to specify dates and territory and indicate “all” for unrestricted property types. Paragraphs 159 and 165 of the procedure under Order No. P/0329 explain how those choices appear in the extract. Selecting only currently registered rights does not answer a question about past rights.

Do not select just one region merely because you live there now. A nationwide check requires Russian Federation coverage. Likewise, a residential-premises filter may leave a land plot or non-residential property outside the response.

For a bankruptcy application, Article 213.4 requires available copies of documents for the transactions it specifies during the three years preceding the application, including real-estate transactions. This does not establish an identical mandatory date range for every EGRN extract: check the purpose of the request and any court order. Do not automatically truncate a required longer period to three years.

Illustrative example. During the selected period, a person held an apartment and a land plot. The apartment right ended following a sale; the plot remains owned. Two entries in a historical extract do not mean two currently owned assets: this example contains one current property and one ended ownership history. The sale contract and payment records require separate review.

How to request information about yourself

  1. Check your full name, identity-document details and the identifiers required by the form. If your name changed, prepare evidence of that change to help investigate any mismatch.
  2. Select the individual-rights extract, dates, territory and property types. Record those settings before submitting.
  3. Use the prescribed form through an authorised official electronic service or an MFC public-service centre. In-person requests require identity evidence. An individual’s electronic request from their personal account may use a simple electronic signature following ESIA identification where the procedure permits it.
  4. If a representative acts, check their authority beforehand. Aggregated information about an individual’s rights has restricted access: Article 62 requires a notarised power of attorney for representation on that basis. Knowing another person’s name does not provide unrestricted access to this extract.
  5. Keep the request number, submission confirmation, resulting document and any electronic-signature files supplied with it.

The general rule in Article 62(9) of Federal Law No. 218-FZ is no more than three working days from Roskadastr’s receipt of the request, unless legislation provides otherwise. MFC transmission is separate: the law allows up to one working day to transmit the accepted request and up to one working day to send the signed result to the MFC. Do not calculate the deadline simply from when you began filling in the form.

Clarify before ordering

“For the case documents I need an individual-rights extract covering [territory], [property types] and [current rights only / specified dates]. Does the selected document match the required scope?”

This is a checklist for agreeing the parameters, not a substitute for the prescribed request form.

Review the response before filing

ResultNext step
A current right appearsCheck the right, ownership share, property and consistency with the inventory
A terminated right appearsMatch the termination date against the contract and payment records
A notice of unavailable informationCheck identity, dates, territory and the information requested; supply the actual response
A refusal or service errorRead the reason, correct the request or establish authority; an error does not prove that no property exists

Absence of a record within the selected scope does not remove the duty to disclose property you know about. If ownership documents exist but the extract does not show the right, supply those documents and explain the discrepancy. A register entry alone does not determine protection of a sole home or the treatment of jointly owned marital property.

Frequently asked questions

Is an extract for my apartment sufficient?

It describes that particular property. If the purpose is to identify the individual’s registered rights across properties, use the corresponding individual-rights extract with suitable coverage.

If I own no real estate now, do I need past-rights information?

That depends on the period being examined and the case-document requirements. An extract restricted to current rights does not provide the necessary historical coverage or replace sale documents.

Does every extract expire after 30 days?

Article 62 does not establish such a universal expiry period: the information is current as of signing. Consider the court’s requirements and subsequent changes and obtain updated information where necessary.

Can a lawyer obtain the information simply using my surname?

Aggregated information about an individual’s rights is restricted. A representative needs proper authority, including the statutory notarised power of attorney where applicable. Do not share your account password.

Does a no-information notice prove I have no assets at all?

No. It is the register’s response within the particular request’s scope. It does not cover movable property or eliminate the need to explain known rights and documentary discrepancies.
