If your Russian permanent residence permit (VNZh) is cancelled, first obtain the notice and the decision identifying the precise ground. Keep the issue, dispatch and receipt dates: different deadlines depend on them. Family, employment or an indefinite permit does not by itself reverse an MVD decision.
Rules checked on 2 November 2026. This guide applies the current Law No. 115-FZ provisions, not future amendments taking effect in 2027.
⚖ Grounds for cancelling a residence permit
Article 9 of Law No. 115-FZ provides general and special grounds. Check both the cited provision and the category under which the permit was obtained: some categories have a different set of grounds or additional conditions. These are common issues, not the complete statutory list.
- Documents and information. False documents or knowingly false information fall under paragraph 1(4). Compare the disputed application with originals and the facts established by the MVD.
- Administrative and criminal circumstances. The offence, period, repetition and status of the judicial act matter. The conditions in subparagraphs 5–7 cannot be replaced with “any two fines”.
- Financial support and housing. Subparagraph 8 concerns proof of the ability to support yourself and family members within the subsistence minimum without state assistance, except where the foreign national is recognised as unable to work. Subparagraph 9 concerns the lack of housing on a lawful basis after three years from entry. Owning an apartment is not the only possible lawful housing arrangement.
- Departure and absence. Subparagraphs 10 and 11 distinguish leaving for permanent residence abroad from spending more than six months outside Russia in total during a calendar year. The latter provides exceptions for inability to leave the foreign country because of the specified emergency treatment, serious illness or death of a close relative, and for official work necessity. Do not replace months with a universal 180-day figure or count only one uninterrupted trip.
- Family basis. Subparagraph 12 concerns a dissolved or invalidated marriage that supported RVP, which in turn supported the VNZh. It does not say every divorce automatically removes every permit. For a permit based on a child, separately examine paragraph 6 and the judicial decisions it specifies.
- Medical circumstances. Examine the actual subparagraph 13 ground, examinations and statutory exceptions. Not every illness has the same consequence.
- Annual notices. Subparagraph 15 concerns continuous failure to notify residence during any two calendar years after receiving the permit. Do not equate one missed deadline with that ground without review; this does not mean other risks of non-compliance disappear.
Other grounds include the holder’s own cancellation request, undesirability or entry-ban decisions, and special category rules. For specialist, IT-worker, investor, resettlement-participant and family-member permits, do not mechanically apply only the general list. Establish the original issue basis.
📅 Appeals and departure: three different deadlines
| Action | Current statutory period | Starting event |
|---|---|---|
| Complaint against the territorial authority’s decision to the federal MVD authority | 3 working days, Article 9(8.8) | Receipt of the decision notice |
| Court challenge | 3 months, Article 9(8.8) | Receipt of that notice |
| Departure after VNZh cancellation | 15 days, Article 31(2) | Issue of the notice, or its electronic/postal dispatch under the prescribed procedure |
Permit cancellation is not the same as a separate deportation decision. However, failure to fulfil the Article 31 departure duty has the statutory consequences. Check any other stay or entry decisions separately. Filing a complaint does not itself mean cancellation has been reversed.
▤ Evidence to collect
- MVD acts: decision, notice, precise statutory provision, date and authority, and evidence of issue/dispatch/receipt.
- Status history: passport and earlier passports after replacement, residence permit, its issue basis, relevant RVP and registration records.
- Ground-specific evidence: annual notices and acceptance slips, income and dependant records, lawful housing documents, travel and exception evidence, family circumstances or judicial acts.
- Chronology: date — event — evidence — legal significance. Distinguish actual receipt from hearing about the problem orally or through a service.
If the MVD alleges missing annual notices
Compare the relevant residence-confirmation years with subparagraph 15. Collect acceptance slips, electronic receipts, postal evidence and replies confirming acceptance. See the annual VNZh notification guide. Simply sending another form does not prove an existing cancellation decision unlawful.
If time spent outside Russia is disputed
List all trips during the relevant calendar year. Reconcile dates against passports and available border-crossing records. If relying on an exception, attach treatment, illness, relative’s death or official work-necessity evidence and explain how it relates to the absence. A ticket alone does not prove all these circumstances.
§ How to challenge cancellation
Article 9(8.8) allows a complaint to the federal MVD authority or a court challenge. Identify the specific decision, infringed right, factual or legal error and requested outcome. The correct authority, court and parties depend on the act and facts. A request to “check the database” is not a substitute for a challenge.
A dispute may concern a wrongly calculated absence, an overlooked exception, timely annual notices, or use of a general ground for a category governed by special provisions. Each argument needs supporting evidence. Family circumstances should be evidenced and assessed, but a Russian spouse or child alone cannot be promised to secure reversal.
Where enforcement threatens rights, consider preliminary protection under Article 85 KAS RF. A court may order a proportionate measure if statutory conditions exist. Explain the specific risk to rights and why protection would be difficult without it. Filing a claim and obtaining a protective order are different events. Read the precise scope of any order rather than assuming that all migration restrictions have been lifted.
Outline of a focused request
“Please provide the residence-permit cancellation decision and information about its legal and factual grounds and the notice’s method and date of dispatch. I disagree for the following reasons: [facts, dates and documents]. Please review the arguments and decide within your powers.” For a complaint or claim, also formulate the request for reversal or a declaration of unlawfulness, identify the act, explain compliance with the deadline and list attachments. This outline does not replace procedural requirements for a court claim.
✓ What follows reversal
If the federal MVD authority reverses its territorial authority’s decision, Article 9(8.9) requires the territorial authority to issue or restore the permit within ten working days after reversal. This is not the general time for deciding any complaint or a promise of restoration ten days after filing.
For a court ruling, examine its operative terms, entry into force and implementation procedure. Obtain documentary confirmation of the outcome and check correction of linked records. Separately assess removal from RKL and any independent decisions. Reversal of one act does not establish automatic reversal of every other act.
Frequently asked questions and sources
Can an indefinite permit be cancelled?
Yes, on statutory grounds. Indefinite validity concerns the document’s term, not exemption from residence conditions.
Do any two fines lead to cancellation?
There is no such universal rule. Check the offences, period, repetition and applicability of the specific Article 9 ground to the permit holder’s category.
May I wait three months before leaving?
The court deadline is not the departure deadline. Compare Articles 9 and 31, notice evidence and any specific protection measures.
