In a Russian logistics company bankruptcy, separate each role first: carrier, freight forwarder, warehouse, agent and digital platform may be responsible for different stages and records. The word “logistics” does not create single liability for the whole chain. Identify cargo location, actual holder, transport and forwarding records, any right of retention, subcontractors, payments, insurance and the date of each breach.
A route has several roles
The transport organiser and actual carrier may be different persons.
Cargo is not a debtor asset
Customer goods are separated from company vehicles, containers and equipment.
Money moves through a chain
Customer advances, freight, storage charges and contractor debt remain distinct.
Quick self-check
- Contract, booking, consignment, forwarding and warehouse records are preserved.
- Actual carrier, forwarder, warehouse, agent and payment recipient are identified.
- Cargo location, condition, quantity and current holder are recorded.
- Retention right, insurance, notices, claim route and deadlines are reviewed.
- Customer advances, subcontractor settlements, charges and refunds are reconciled.
Responsibility Across the Logistics Chain
The contract and actual performance show who accepted cargo, arranged the route, carried and stored it. One brand may use several entities and subcontractors. A forwarder claim cannot automatically be replaced with a carrier or warehouse claim.
Cargo Location and Handover Evidence
Review consignment notes, forwarding receipts, warehouse records, seals, tracking, acts and messages. A platform status helps but does not replace primary records. Where a subcontractor holds cargo, identify its legal basis and release procedure.
Third-Party Cargo, Retention and Debtor Assets
Customer cargo does not enter the estate merely because the debtor holds it, but ownership and identification must be proved. Review any retention right, debt for the specific service, vehicles, containers, packaging, forklifts and warehouse equipment separately.
Loss, Damage, Insurance and Claims
Record condition, value, route, risk point, notices and insurance. Insurance may not cover the whole claim and does not remove the need to identify the responsible participant. Pre-action requirements and deadlines depend on contract and transport mode.
- stop movement of disputed cargo;
- record condition and location;
- notify participants and insurer;
- collect primary records;
- calculate loss without duplication.
Advances, Subcontractors and Customer Steps
Separate unused customer advance from cargo loss. Carriers and warehouses prove their own services and debts. Obligations arising after proceedings begin require a separate current-payment analysis. Monitor the bankruptcy register and court case rather than waiting for individual notice.
| Participant or asset | Review | Action |
|---|---|---|
| Forwarder | Instruction and records | Identify accepted duty |
| Carrier | Consignment note and route | Record handover |
| Warehouse | Receipt and balance | Identify cargo holder |
| Third-party cargo | Title and identification | Separate from estate |
| Advance and charges | Purpose and performance | Calculate separately |
