Uninsured At-Fault Driver: Damage Recovery and Case 2-425/2018

This page covers partial recovery in Russian case 2-425/2018 and the limits of its one-page court record. Separate case 2-844/2019 concerns a default judgment against the owner when another person drove the vehicle.

If the at-fault participant has no Russian compulsory motor liability insurance (OSAGO), a vehicle-damage claim generally needs preparation against the proper responsible person under civil-law rules. Your own OSAGO policy does not mean your insurer must pay for every collision involving an uninsured driver. This article examines evidence and the preserved court example in case 2-425/2018, where damage and costs were awarded in part.

🔎 Why direct compensation does not apply automatically

Direct compensation is a specific procedure under Article 14.1 of the OSAGO Law. Its conditions must coexist, including a collision of two or more vehicles whose owners’ liability is insured, with damage only to those vehicles. An uninsured participant prevents use of this route. This differs from a direct civil claim against a person liable for the damage.

⚖️ Important distinction. A penalty for not having insurance and liability for damage are separate issues. Punishment for breaching the insurance obligation does not replace evidence of the loss or civil responsibility.

🔎 Court example: case 2-425/2018

The media library associated with this publication contains the operative part of a default judgment dated 17 September 2018. The case was heard in Domodedovo, Moscow Region, by the justice of the peace for judicial district 33 acting for district 38. The document identifies P.I. Petrov as the claimant’s representative.

The court partly granted the claim for material damage caused by a road accident. The operative part lists an award of damage, expert expenses, the court fee and representative costs. The remaining claims were refused. Amounts and party details are redacted in the published copy; they are not reproduced or estimated here.

One page: the operative part, not the full reasoned judgment.

QuestionWhat the PDF establishesWhat it does not explain
OutcomeThe claim was partly grantedWhy part of the claim was refused
AwardDamage and the listed litigation costsThe redacted amounts and full calculation
InsuranceThe file is attached to the uninsured-accident articleThe operative part does not state the reasoning about an absent policy

The source demonstrates a real court award but does not justify promising full recovery in a comparable claim. The appeal wording in the 2018 document is historical text; the current procedural route must be checked separately.

🔎 Who should receive the damage claim?

The proper defendant depends on possession and use of the vehicle, the accident mechanism and the basis of liability. The driver cannot always be equated with the registered owner. Employment duties, rental, other lawful possession or unlawful taking can involve different rules and evidence.

Civil Code Articles 1064 and 1079 govern harm and sources of increased danger. Damage caused to the owners by interaction of such sources is compensated on the general basis in Article 1064. A claim needs the event, causation, liability of the identified person and the supported loss amount. A judgment does not itself establish that the defendant has funds for enforcement.

📂 Documents to preserve after the accident

InsurancePolicies and verification of their validity on the accident dateSelect the insurance or civil route
Cause of damageInspection, diagnostics and specialist opinionConnect the damage with the particular collision

Record the damage and retain original files first. Repairs needed for safety should not be postponed mechanically, but verifiable evidence of the pre-repair condition is essential. If you have voluntary comprehensive insurance, assess the claim under that contract; the other participant’s missing OSAGO policy does not establish in advance whether your comprehensive insurer will pay or refuse.

Compensation fund, demand and recovery

Article 18 of the OSAGO Law distinguishes compensation for injury or death from property damage. The absence of the responsible person’s compulsory insurance is among the grounds for injury or death compensation. That fact alone is insufficient for vehicle damage: property compensation has different statutory grounds. Repair payment through the Russian Association of Motor Insurers should not be promised solely because the at-fault person has no policy.

1. Check the route

Type of harm, policies and any comprehensive-insurance contract.

2. Collect evidence

Responsibility, accident-related damage and the claim amount.

3. Prepare the demand

Recipient, calculation, attachments and delivery evidence.

4. Follow through

Court proceedings and separate enforcement assessment after judgment.

The demand should set out chronology, legal grounds, damage and calculation. Check jurisdiction, defendants and the court fee when preparing proceedings. An oral acknowledgement does not guarantee payment; a settlement should record the amount, dates and performance terms. The partial award in the published case also illustrates why each claimed item requires its own support.

Frequently asked questions

Will my own insurer pay if the at-fault driver has no OSAGO?

Your OSAGO does not automatically create that obligation. Direct-compensation conditions must be met. A separate comprehensive-insurance contract requires assessment under its terms.

Can the motor-insurers’ association pay for repairs?

The responsible person’s missing OSAGO alone is insufficient for property compensation. Article 18 distinguishes the grounds by the type of harm.

Is the driver always the defendant?

No. Establish lawful possession, how the vehicle was used and the basis of liability. Driver and registered-owner details do not always resolve the question by themselves.

Was the whole amount claimed in case 2-425/2018 awarded?

No. The available operative part records a partial award and refusal of the remaining claims. The amounts are redacted and the reasoning is not attached.

Does the judgment show that money has been received?

No. An award and actual enforcement are different. The available document does not confirm payment by the defendant.
