If the person responsible for a road accident has no valid compulsory motor-liability insurance, the absence of an insurance policy does not remove the underlying civil-law duty to compensate property damage. The claim should be built on the accident evidence, the legal basis for liability and proof of the actual loss.
Identify the responsible person
For vehicle damage, responsibility may depend on who was operating and lawfully controlling the vehicle, the accident materials and the applicable rules on sources of increased danger. The driver’s acknowledgement can assist, but it should be supported by official accident documents and other evidence.
Document the loss
- accident report, police documents and photographs;
- vehicle registration documents and proof of ownership or lawful possession;
- repair estimate, expert report and invoices;
- proof of payments and correspondence with the responsible person;
- information about insurance status, where available.
Pre-trial demand and payment
Send a written demand that states the accident, legal basis, calculation, supporting documents and a reasonable deadline to pay. A proposed instalment arrangement should be recorded clearly. Agreement by the other party does not itself secure payment: enforcement depends on a binding settlement or a court judgment if voluntary payment does not occur.
Court claim
If payment is not made, a civil claim may seek the substantiated property loss and, where the legal conditions are met, related expenses. The court will assess the accident circumstances, causal connection, the actual amount of loss and the evidence for each item.
