Buying a Parking Space at a Russian Bankruptcy Auction: Buyer Checks

🅿️ A painted bay number is not a cadastral identifier. Before bidding, establish whether the lot is separate real property, a share or merely a use right, and whether your vehicle can actually use it.
01 · ReconcileLegal object and location on the plan.
02 · Check fitDimensions, ramp, turns and access.
03 · CompleteTitle, charges and access passes.

Separate property, share and use right

Civil Code Article 130 treats a vehicle-parking part of a building or structure as real property where its boundaries are described through the prescribed cadastral process. Painted lines alone do not establish that status.

If the notice and contract describe different objects, request clarification before submission. Do not assume that a purchased share becomes separate property without additional legal grounds and steps.

Match the register to the parking plan

  1. Compare cadastral number, area, level and address throughout.
  2. Locate the object on the cadastral or technical plan against adjacent bays, columns and aisles.
  3. Check debtor’s title, restrictions and supporting instruments.
  4. For a share, investigate who may use the actual bay, under what arrangement and for how long.
  5. Identify disputes and current occupation.

An oral “this number is always yours” assurance cannot change the contract’s object. A separate case note concerns parking-space title litigation and does not guarantee the same outcome elsewhere.

Area alone does not prove vehicle fit

Check length, width, columns, doors and boot opening, the ramp, turns and manoeuvring. A tall vehicle must fit the entire access route, rather than just the space above the bay.

Record leaks, obstacles, markings, entrance condition and access rules. Mechanical parking also requires checking permitted vehicle parameters, operation, maintenance and downtime. Title documents are not a technical fitness assessment.

🚗 Buyer inspection record

Record lot and cadastral IDs, plan location, vehicle and route limits, door obstacles, entry method and hours, occupier, dated photographs and unanswered questions. Agree any safe drive-through check with the responsible person.

Management and recurring costs

Request tariffs, management or service agreements and their legal basis, pass-issue procedure and use restrictions. Check utility and maintenance charges, equipment servicing and possible one-off expenses separately.

A former-owner debt certificate does not automatically transfer every amount to the buyer. Review each claim’s basis and any special rules for this object. Establish the date and evidence used to change the payer and access rights.

From application to actual handover

Check the application and admission, then protocol, contract, payment and registration evidence. Registration Law Article 26 includes independent suspension grounds: an auction protocol does not remove all registration obstacles.

The handover record should identify the space, vacant possession, keys, passes, remotes, documents and discrepancies. For electronic access, test the new pass and follow the proper procedure for ending the former user’s access.

Hypothetical example: price RUB 600,000; credited deposit RUB 60,000; balance RUB 540,000. Separate costs of RUB 50,000 produce an initial budget of RUB 650,000. Recurring charges are additional and should be calculated over your chosen period.

If the object is an enclosed garage, use the garage-lot checklist.

Frequently asked questions

Does the painted number establish separate ownership?

No. Reconcile the register, lot description and plan; physical numbering and legal identity may differ.

Can any share become a separate space?

No. Statutory grounds and evidence are needed. Do not assume feasibility or cost in advance.

Can I skip inspection if I know my car’s size?

Columns, ramps, turns, doors, headroom and access rules can still prevent practical use.
