Overtime in Russia: Records, Consent and Pay

RUSSIAN LAW · PRACTICAL GUIDE

Establish the hours and reason for overtime

Overtime is work performed at the employer’s initiative beyond the employee’s established working hours. It requires accurate records and compliance with the rules for involving employees.

When overtime is permitted

Article 99 of the Russian Labour Code governs the grounds and procedure. Written consent is required in certain situations; particular employee categories have additional safeguards and restrictions.

Documentation

  • Record the reason and extent of the work.
  • Obtain consent when required.
  • Check restrictions applicable to the employee.
  • Keep accurate records of hours.

How to check overtime pay

Check Article 152 in the version applicable to the period worked. Relevant factors include the pay system, compensatory and incentive payments, hours and time-recording arrangements. Multiplying base salary alone without checking the other components is insufficient.

Ask the employer for a calculation by date and hour. Compare the collective agreement, internal policies and conditions for enhanced pay or additional time off. Aggregated working-time records and special situations require a separate review of the applicable rules.
