Loan Issued Despite a Russian Credit Self-Ban: Disputing the Debt

If a loan was issued despite your credit self-ban, first check the agreement date, the ban’s scope and the information the creditor obtained from credit bureaus. Then submit a reasoned dispute to the creditor and, where justified, request credit-record correction. A current self-ban entry alone does not settle every dispute about an earlier agreement.

Legal provisions checked on 21 October 2026. This guide concerns Russian-law consumer credit and loans from banks and microfinance organisations.

Compare dates

Application, effective ban, creditor enquiry, agreement and disbursement may all occur on different days.

Request the checks

Obtain results from all qualified credit bureaus the creditor had to query, together with the ban’s conditions.

Dispute the record

The payment demand and the agreement’s credit-history entry require separate assessment.

First steps when you discover a loan despite a ban

  1. Identify the creditor and agreement. Obtain a credit report and save the agreement number, date, amount and reporting source. Check whether the transaction belongs to a contract made before the ban.
  2. If you do not recognise the agreement, tell the creditor. Request origination and disbursement documents. Where there are signs of identity misuse, secure your banking and account access through official channels and report the facts to the police.
  3. Keep self-ban records. You need conditions, effective dates, removal information and changes over time rather than only a screenshot of today’s status.
  4. Submit a written dispute. Identify the agreement and grounds. If you applied personally, describe that accurately: a failure to observe the ban and an absence of your consent are different factual issues.
  5. Check court and enforcement activity. A creditor complaint does not replace objections to a court payment order or a defence to a claim, and does not automatically stay enforcement.

When performance cannot be demanded

Part 6 of Article 13 of Federal Law No. 353-FZ provides two grounds:

  • the creditor breached its enquiry obligation under Article 7(4.5), and an effective ban covering the agreement was recorded on the agreement date;
  • the creditor breached the duty to refuse the agreement under the first sentence of Article 7(4.6).

These are specific statutory conditions, not a rule that setting a ban cancels all loans. Examine agreement and creditor type, contracting channel, restriction history and the creditor’s conduct. Mortgages, vehicle-secured credit and qualifying state-supported main education loans fall outside the mechanism; establish precise boundaries under Article 5.1 of Law No. 218-FZ and Article 7 of Law No. 353-FZ.

Why the creditor’s bureau enquiry within thirty days matters

Under Article 7(4.5–4.6) of Law No. 353-FZ, the creditor must query all qualified bureaus no earlier than 30 calendar days before the agreement. The duty to refuse is linked to obtaining information about an effective ban covering that agreement. Check the enquiry date and result even if a ban was effective when money was paid.

Hypothetical situationWhat to establishPermissible conclusion
Ban effective on 5 October; enquiry on 10 October confirms it; agreement on 12 OctoberWhether the ban covers this creditor and contracting channelIf conditions are established, assess breach of the duty to refuse
Enquiry on 1 October finds no ban; ban starts on 5 October; agreement on 12 OctoberWhether all required enquiries were made within the 30-day validity windowThe ban’s existence on 12 October alone does not establish a breach
Ban set after the agreementAgreement date rather than just the first repayment dateA later ban does not apply retrospectively

These are hypothetical examples, not court cases. Article 7(6) distinguishes when bank consumer credit and a consumer loan agreement are concluded: agreement on individual terms for credit, and transfer of funds for a loan. A date on the cover page or a transaction date alone may therefore be insufficient.

Documents for disputing the loan

Disputed-loan evidence checklist

Ask the creditor what information it received, when and from which qualified bureaus, which restriction it assessed and why it considered the agreement permissible. If you cannot obtain documents yourself, explain that in the dispute and consider asking the court to obtain them.

Correcting the credit-history entry

Article 8(4.1-1) and (4.1-2) of Law No. 218-FZ provide a special dispute route: where an effective ban covering the agreement existed on the creditor’s enquiry date, agreement information must be annulled on an application to the bureau or reporting source. If those circumstances exist, the source must send information requiring annulment within 10 working days after receiving the bureau’s request or the individual’s statement.

If the issue is an absent enquiry, incorrect identification or an agreement made by someone else, state those grounds and request investigation. Do not automatically describe an effective ban on the enquiry date where no enquiry occurred. Article 8 also sets the general record-dispute procedure.

The deadlines govern different actions. The general bureau verification period is 20 working days after receipt, subject to statutory exceptions. The source’s special-ground action period is 10 working days after receiving a request or statement. This does not promise an entire clean history ten calendar days after posting a letter.

Sample statement to the creditor or bureau

Use the actual facts of your agreement. Identify the entry and reporting source for a bureau; also dispute the payment demand when addressing the creditor.

To [creditor / bureau]
From [full name, contact and identification details required by the applicable form]

I dispute the information and payment demand concerning agreement [number, date, creditor], amount [amount]. I discovered this agreement on [date, source]. Origination circumstances: [accurate account; expressly state if you did not personally make the agreement].

Notification [reference] records a self-ban covering [creditors, contracting channel] effective from [date]. Removal information: [present / absent, dates]. Please verify compliance with Article 7(4.5–4.8) of Law No. 353-FZ, identify the dates and results of enquiries to all qualified bureaus, provide supporting documents and explain whether Article 13(6) applies.

If the circumstances under Article 8(4.1-1) and (4.1-2) of Law No. 218-FZ are established, please carry out the required steps to annul information about this agreement. Otherwise, state the specific grounds and documents supporting the entry’s accuracy. To the creditor: please stop demanding performance insofar as the law prevents it and report your investigation’s outcome.

Submit through official channels and keep registration and receipt evidence. Do not send payment codes, CVC/CVV or account access. Annulment of one agreement’s information does not erase an otherwise accurate credit history.

If collection continues

Compare the response with the records: did the restriction cover the agreement, was it effective at the legally relevant time and did the creditor perform its checks? An unresolved regulatory-compliance issue can be raised with the Bank of Russia, while rights may be defended in court. Determine the correct court remedy and applicable pre-action process for the particular dispute. A regulator complaint is not a substitute for litigation steps.

If a court payment order arrives, do not wait for the bank correspondence to end: Article 128 of the Civil Procedure Code provides ten days from receipt for objections. Check service and procedural time-calculation rules; late objections require a separate basis for acceptance. If sued through ordinary proceedings, submit your defence and evidence to that court.

If bankruptcy proceedings are already ongoing: disclose the disputed claim and its grounds within the case, providing documents and objections when the creditor’s claim is considered. Do not treat listing a debt in documents as agreement with it: expressly identify the disputed part. After bankruptcy completion, separately establish whether the agreement predates the procedure or arose later; a self-ban and debt discharge are different grounds of defence.

Frequently asked questions

Does an active self-ban mean I can immediately stop paying every loan?

Check the agreement and the conditions in Article 13(6) of Law No. 353-FZ. A restriction may be later, partial or inapplicable to that product. Submit a reasoned dispute.

The creditor relies on checks made weeks before the agreement. Is that permitted?

The law provides for enquiries no earlier than 30 calendar days before the agreement. Examine dates, all required bureaus and the information obtained. An enquiry made before the agreement date is not itself proof of a breach.

Must my entire credit history be deleted within ten days?

No. The source’s special period is ten working days and applies only where statutory conditions exist. The dispute concerns a particular agreement rather than all accurate entries.

Must every such dispute be reported to the police?

If you personally made the agreement and the issue is failure to observe the ban, describe those facts. If another person appears to have made it or funds were stolen, a police report is a separate step; it does not replace disputes with the creditor and bureau.

Will removing the ban now cure an earlier breach?

The legally relevant historical information and conduct determine the dispute. Current removal does not automatically change past events, just as a new ban does not apply retrospectively.
