Russia’s personal-attendance property safeguard is an EGRN record under Article 36 of Federal Law No. 218-FZ of 13 July 2015. The owner asks that transfers, termination, restrictions of title and encumbrances not be registered without the owner or statutory representative participating. The record helps prevent registration on someone else’s application, but it is not an asset seizure and does not block every possible legal action.
Property and owner
Check the cadastral number and your registered title.
Up to 5 working days
The entry deadline runs from receipt by the rights-registration authority.
Statutory exceptions
Court decisions and authorised bailiff requests can still support registration.
What the EGRN record blocks
Under Article 36(3), the record generally requires returning without consideration a registration application made by someone other than the owner or statutory representative. It covers transfers, termination, restrictions and encumbrances of the relevant property title.
An ordinary agent’s notarised power of attorney must not automatically be treated as a substitute for personal attendance when the record is active. A statutory representative, such as a parent acting for a minor in the relevant circumstances, is a separate legal category. If a transaction will use a power of attorney, clarify the record with the notary and registration specialist in advance.
The record does not itself correct the register if ownership has already been unlawfully transferred. That requires examination of the registration documents and separate protective measures, rather than only a new safeguard application.
Who can apply and what to prepare
Article 36 permits an application by the person listed in EGRN as owner, a statutory representative or an agent acting under a notarised power of attorney. An agent’s ability to apply to establish the safeguard does not authorise later registration contrary to it.
- The applicant’s identity document.
- The address and cadastral number; verify every property separately if there are several.
- Registered title and share information for co-owned property.
- Evidence of authority if a representative applies.
- A working channel for notifications and the outcome.
For shared ownership, establish whose title the application covers. One co-owner’s request should not automatically be treated as protecting every other owner’s rights.
How to set the safeguard and verify it
- Reconcile your details and properties against EGRN. If title is unregistered or someone else is listed, establish why first.
- Submit the personal-attendance registration application through the designated online account or an MFC providing the service.
- Keep the receipt and application reference. Online, ensure the request was submitted rather than left as a draft.
- Wait for the outcome and verify that the record covers the correct property. Obtain up-to-date EGRN information if needed.
- If no entry appears, ask for an explanation using the reference: submission is not the same as entry.
Article 36(1) permits submission through the online account without the applicant’s enhanced qualified electronic signature. This does not remove identification or the service’s own requirements. Do not purchase a signature solely because of a generic online recommendation.
Deadlines and typical situations
| Situation | Rule | What to check |
|---|---|---|
| Adding the record | No more than 5 working days after Rosreestr receives the application | Registration-authority receipt date and outcome |
| Someone else applies while it is active | Generally returned without consideration | Article 36(3) exceptions |
| Notice returning that other application | Within 5 working days after its acceptance | Return reason; this is a separate deadline |
| The owner attends personally | The transaction may proceed under the general conditions | Removal of the record during registration |
Hypothetical example: the owner visits an MFC, but notice that Rosreestr received the papers arrives later. Do not count five working days solely from the MFC visit: the statute ties the deadline to receipt by the registration authority. Preserve both dates and follow the application’s actual status.
Removing the record before a transaction
Article 36(2) provides for removal following the owner’s or statutory representative’s withdrawal request; a final court act; or the registrar’s decision alongside registration of transfer or termination with the owner or statutory representative participating personally, as well as registration by inheritance.
If selling through an agent, do not wait until the contract is submitted to check the record. Establish the permitted withdrawal procedure, submit the required application, wait for the outcome and then coordinate registration. Use the form provided by the current service: a private letter to the buyer or agent does not remove the record.
For the owner’s personal participation, the law allows removal alongside the relevant registration; insisting on advance removal in every case is inaccurate. Check the chosen transaction route in advance nevertheless.
What the safeguard does not replace
Article 36(3) expressly preserves registration based on a final court judgment, a bailiff request in cases allowed by law and other grounds established by federal statutes. The record does not remove property from enforcement or confer immunity in bankruptcy.
It also does not itself block account access, credit issuance, new SIM contracts or the signing of agreements. If you discover an unknown transaction, preserve documents, secure your accounts and seek assessment of urgent legal measures. Do not wait for the entry deadline if a breach has already occurred.

Frequently asked questions
Does this completely prohibit selling the property?
No. The owner may attend personally, and the statute permits withdrawal and other removal grounds. This is a specific registration safeguard.
Can an authorised agent establish the record?
Article 36(1) allows an agent under a notarised power of attorney. Check the authority. A later transaction through an agent while the record remains active is a separate issue.
Does it prevent bailiff enforcement?
No. The statute contains exceptions for bailiff requests and court acts. It cannot guarantee protection from lawful enforcement.
Does one request automatically cover all my apartments?
Do not assume that. Check the property list in the application and the outcome for every cadastral number.
