If your work patent has been cancelled, first establish the date and precise legal ground of the MVD decision. A tax receipt or an appeal does not by itself reverse cancellation or authorise continued work. Check your basis for staying in Russia separately: lawful employment and lawful stay are related but distinct questions.
Checked on 2 November 2026. This guide concerns a visa-free foreign national’s work patent under Article 13.3 of Law No. 115-FZ, not an individual entrepreneur’s tax patent. Changes taking effect on 1 January 2027 are not applied here.
↔ Cancellation and expiry: the difference
People may describe any negative check result as a “cancelled patent”. That is insufficient to choose a remedy. Obtain a document or official response distinguishing a cancellation decision from the end of a paid period, refusal to reissue and an error in the records.
| Situation | Meaning | What to check |
|---|---|---|
| Cancellation decision | The MVD applied Article 13.3(22) | Date, number, specific ground, established facts and notice |
| Paid period not extended | Under paragraph 5, validity ends on the day following the last paid day | Periods, timely fixed advance personal income tax payments and correct details |
| Refusal to issue or reissue | A separate decision, also affecting a further application | Reasons, documents and employment records |
| A service cannot find the document | A screen alone does not establish the legal ground | Query details and the issuing authority’s official response |
For example, if the paid period ends on 30 November and the next period is not paid on time, paragraph 5 links the end of validity to 1 December. This illustrates the rule rather than determining a particular patent’s status. Do not treat a late payment as automatic reinstatement. If payment was timely but recorded incorrectly, obtain the payment evidence and reconcile the records.
⚖ Why the MVD may cancel a work patent
Article 13.3(22) sets out specific grounds and incorporates selected provisions of Article 18. Identify the exact provision used in the decision: a general reference to a migration violation does not replace checking the underlying facts.
- Using third-party labour when carrying out the foreign national’s work.
- Circumstances under Article 18: including false documents or knowingly false information, specified criminal and migration circumstances, medical grounds subject to statutory exceptions, an undesirability decision or an entry prohibition. Paragraph 22 refers to Article 18(9), subparagraphs 1–10 and 15, paragraphs 9.1 and 9.2, and paragraph 9.7(1). Their conditions differ.
- The foreign national’s own application to cancel their patent.
- Failure to submit the notice and documents required by paragraph 7. Under the current rules, within two months after issue the foreign national must notify the issuing territorial MVD authority of employment activity. Attach the employment or civil-law contract copy; where an oral civil-law contract is legally permitted, report its details in the notice.
- No record of the employer or customer that is a legal entity or individual entrepreneur in the relevant state register, EGRUL or EGRIP.
For a medical ground, check the actual findings, examination deadlines and applicable exceptions. For an entry prohibition or undesirability ground, also examine the underlying decision by the relevant authority. Correcting a patent record does not automatically reverse that other decision.
✓ What to do when you learn of cancellation
- Obtain MVD documents. Request the decision or its date, number, legal ground, established facts and appeal procedure. Under paragraph 28, cancellation notice is sent to the foreign national and employer or customer within three working days after the decision. This is a dispatch deadline, not a guarantee of receipt that day.
- Record when you learned of the rights violation. Keep the notice, envelope, electronic message, MVD response, check result and employer correspondence. Do not postpone assessing the court deadline until a more convenient form of document arrives.
- Coordinate with the employer. Do not continue work solely on the basis of the former patent or a complaint. Employment consequences require a separate assessment of the reason the document ceased to be valid and any other lawful work entitlement.
- Check lawful stay and other decisions. Permitted-stay expiry, migration registration, shortened stay, administrative expulsion, deportation and entry prohibitions each need separate review. Do not assume everyone may stay for an extra month.
- Choose protection appropriate to the ground. Incorrect records, a disputed timely notice and an existing entry prohibition call for different evidence and claims.
Check the Register of Controlled Persons separately. A patent check does not replace a migration-status check.
▤ Documents to prepare
| Disputed issue | Evidence | Purpose |
|---|---|---|
| Notice allegedly missing | Notice copy, contract, receipt stamp, postal inventory and delivery evidence, electronic receipt | Who submitted what, where and when; whether the required material was complete |
| Payment not recorded | Receipts and bank records, taxpayer number, payment details, covered periods, reconciliation result | Timely payment attributed to the correct person and period |
| Incorrect employer data | Contract and EGRUL/EGRIP information as of the relevant date | Actual contracting party and its registration |
| Another decision or circumstance | Underlying decision, relevant materials, medical documents or administrative decisions, depending on the ground | Whether the asserted ground exists and applies to this person |
Outline of a request to the territorial MVD authority
State your full name, date of birth, citizenship, passport and patent details and reply address. Explain when and how you learned of cancellation. Request the decision or its date, number, precise legal ground and factual basis; information about dispatch of the notice; review of identified discrepancies and correction of any established error where legally justified. Attach relevant documents and keep proof of submission.
This request helps obtain evidence. It does not replace a court claim and does not itself suspend the decision or the court deadline.
§ Challenging the decision and applying for a new patent
A citizen’s challenge to an MVD decision is generally brought under administrative judicial procedure. The general rule in Article 219(1) of the Code of Administrative Judicial Procedure (KAS RF) is three months after learning of the rights violation, unless a special period applies. Identify the proper respondent authority, court and claims from the documents rather than the name of an online service.
Link the request to declare the decision unlawful to the actual error: timely submission of the notice, an inapplicable legal ground, incorrect facts or a statutory exception that was not considered. Attach the decision, chronology, evidence and documents required under KAS RF. If late, request restoration of the deadline and prove valid reasons; restoration is not automatic. A response to an ordinary information request does not by itself start a new three-month period.
Filing a claim is not a stay of cancellation. Where grounds exist, apply for preliminary protection under Article 85 KAS RF. Explain the risk to rights, difficulty of protection without the measure and proportionality of the specific measure requested. The court decides. Even if an order is made, check exactly which actions it permits or suspends and the remaining requirements for work and stay.
Do not automatically equate the end of the paid period under paragraph 5 with formal cancellation under paragraph 22 and impose the same one-year restriction without checking the legal status. See the separate work patent application guide.
? Frequently asked questions
Does a late tax payment restore the patent?
Do not treat it as automatic reinstatement. Distinguish a timely payment recorded incorrectly, expiry of the paid period and a cancellation decision. Each requires appropriate evidence and a legal basis.
Is having a contract enough if no notice was submitted?
The contract itself does not replace the Article 13.3(7) notice. Check submission and the required material. For an oral civil-law contract, the law provides for reporting its details; this does not remove the notice duty.
Can I work after filing a complaint?
A complaint or court claim alone does not restore work entitlement under a cancelled patent. A valid work basis and an assessment of any specific protection measures are necessary.
Can I immediately obtain a patent in another region?
Changing regions does not remove the one-year restriction under paragraphs 3 and 24 after cancellation or refusal. First review the decision and possible challenge.
Is cancellation of a patent already deportation?
They are different measures and documents. Loss of a patent requires a separate check of lawful stay and any other decisions. Do not automatically transfer deportation procedures and deadlines to a patent dispute.
