Cancellation of a Russian temporary residence permit (RVP) must be assessed against the specific Ministry of Internal Affairs decision and Article 7 of Federal Law No. 115-FZ. Immediately preserve the notice and its issue, dispatch and receipt dates: the administrative appeal, court challenge and departure deadlines follow different rules.
Checked on 2 November 2026. This guide concerns an ordinary RVP. A permit for educational purposes (RVPO) is governed by the separate Article 7.1. Future 2027 provisions are not applied here.
⌖ Cancellation, expiry and a move to VNZh
Expiry of an RVP, cancellation of an existing permit and refusal to issue one are different situations. A verbal statement or a service error does not establish the type and details of the official act. Obtain the decision and notice, their number and date, the issuing authority and the exact legal provision.
Under Article 7(1.8), an RVP becomes invalid when a residence permit (VNZh) is issued or Russian citizenship is acquired. This is not the same as cancellation for a violation. When changing status, compare the dates and documents first. See the ordinary route in VNZh after RVP.
§ Grounds to examine
The following are main groups of issues, not an exhaustive list under Article 7. For participants in the compatriot resettlement programme and their family members, paragraph 1.6 establishes a specific set of grounds and also addresses loss of that status.
| Ground | What to establish |
|---|---|
| Documents and information | Which documents were considered forged or false, or which information was knowingly false. Compare the application, originals and the authority’s findings: Article 7(1)(4). |
| Administrative and criminal matters | The offences, dates, repetition and status of rulings or convictions. Subparagraph 7 does not mean any two fines: it specifies certain offences and separately addresses drug-related administrative offences. |
| Employment, income and family support | The relevant period, lawful resources, dependants and exceptions under subparagraph 8, including specified students, pensioners and persons with disabilities. The test cannot be reduced to a single bank balance. |
| Travel and permanent departure | Permanent relocation abroad is distinct from absence exceeding six months in total in a calendar year. Subparagraph 11 includes exceptions relating to inability to leave because of emergency treatment, serious illness or a close relative’s death, and absence for official work reasons. |
| Marriage and children | Subparagraph 12 concerns the marriage that formed the basis for the RVP, where it is dissolved or declared invalid. For a permit based on a child, subparagraph 16 links consequences to specified final court decisions. |
| Medical matters and other restrictions | The precise condition under subparagraph 13, applicable exceptions and medical examination requirements. An undesirable-stay decision or entry ban is assessed separately under paragraph 1.2. |
Other grounds also exist, including lack of a lawful basis for using residential premises after the prescribed period and the foreign national’s own request for cancellation. Check your decision against the full current provision rather than relying solely on this table.
◇ If the permit was issued for education: RVPO
RVPO is governed by Article 7.1 of Law No. 115-FZ, rather than the ordinary Article 7 list. Check the permit name and issue basis. Switching to part-time or correspondence study and ending studies early are addressed in subparagraph 12 of paragraph 1; a qualifying transfer has a separate exception.
When transferring: paragraph 9 of Article 6.2 requires evidence of admission to another qualifying state educational or scientific organisation to be provided to the territorial MVD body that issued RVPO no later than 30 days after the order terminating studies because of the transfer. The period runs from that order, not the start of the next semester. Keep both orders, evidence of full-time study and the programme, a copy of the document submitted and proof of receipt. Failure to provide it on time is separately covered by paragraph 2 of Article 7.1.
An RVPO complaint to the federal MVD body must be filed within three working days; a court challenge within three months after receiving notification: paragraph 7 of Article 7.1. Where the federal MVD body reverses the decision, paragraph 8 requires issue or restoration within three working days after reversal. Challenge periods do not replace checking the current right to stay and any interim protection.
Does an RVPO holder submit the ordinary annual RVP notification?
Paragraph 11 of Article 6.2 exempts RVPO holders from the notification in the first subparagraph of paragraph 9 of Article 6. This does not remove all migration obligations. If a decision applies the ordinary RVP procedure, compare it with the actual status. Addition checked on 3 November 2026; future 2027 amendments are not applied.
📅 Three deadlines that must remain separate
| Action | Time limit | Starting event |
|---|---|---|
| Appeal to the federal Ministry of Internal Affairs | 3 working days — Article 7(4) | Receipt of notice of the decision |
| Court challenge | 3 months — Article 7(4) | Receipt of the notice |
| Departure following cancellation | 15 days — Article 31(2) | Issue of the notice or its electronic or postal dispatch under the prescribed procedure |
The three-month court deadline does not grant three months of lawful stay after cancellation. The departure provision also refers to dispatch, while the appeal provision refers to receipt. Preserve the envelope, tracking and electronic messages. Do not assume a request for a copy extends any deadline.
Failure to comply with the departure duty entails deportation under Article 31. Cancellation and a deportation decision are not interchangeable. Article 7(2.1) provides a separate route for issuing a temporary identity document to a stateless person; do not mechanically apply a foreign passport holder’s route.
▤ Documents for review and protection
- The act and delivery: decision, notice, attachments and evidence of issue, dispatch and receipt.
- Status history: passport, RVP, its original legal basis, registration documents, applications and previous official replies.
- Evidence addressing the ground: income and family records, employment or study documents, court rulings, medical evidence or travel history, depending on the stated reason.
- A timeline: date, event, supporting document and legal significance. Identify protective deadlines separately.
If the authority miscalculated travel
List all exits and entries in the relevant calendar year. Do not count only the last trip or replace six months with a universal 180-day figure. For an exception, prove the reason, period and connection to inability to leave or official work needs.
If the dispute concerns income or a notification
Collect evidence for the relevant period, information about dependants and applicable exceptions. Keep filing confirmations with a copy of the notification. A late repeat submission does not itself reverse an existing cancellation decision.
↗ Challenging the decision and checking restoration
Article 7(4) provides for an appeal to the federal Ministry of Internal Affairs or a court challenge. Identify the exact decision, affected right, factual or legal error and requested cancellation. For an administrative claim, establish the competent court, defendant, attachments and procedural requirements separately. Asking to check a database does not replace a substantive challenge.
If a deadline has passed, assess the applicable restoration procedure and evidence explaining the delay. Consideration of an ordinary enquiry does not automatically restore a court deadline.
If the federal Ministry cancels its territorial authority’s decision, Article 7(5) requires the territorial authority to issue or restore the RVP within three working days from cancellation. This is not the time limit for deciding every complaint. Following a court judgment, examine its terms and enforcement procedure.
Obtain confirmation of restoration and check related records and separate restrictions. If your details are in the Register of Controlled Persons, examine the ground and removal procedure. Reversal of one act does not establish that every other restriction has automatically ended.
Questions and primary sources
Does every divorce lead to RVP cancellation?
Subparagraph 12 concerns the marriage that formed the basis for the particular RVP. Establish the original basis first; divorce alone does not replace that assessment.
Does obtaining a VNZh mean RVP conditions were violated?
No. Article 7(1.8) links RVP invalidity to obtaining a VNZh or Russian citizenship. This must be distinguished from cancellation on an adverse ground.
Can I await an official reply without checking the departure deadline?
No. Appeal and departure deadlines are separate. Assess the decision, notice, current status and any specific protective measures together.
