Can a Working Phone Be Returned in Russia?

A working phone bought in a Russian physical store cannot normally be returned merely because the buyer has changed their mind. The answer depends on the transaction route, the phone’s characteristics and warranty, and whether there is an actual defect.

Short answer. Article 25 permits exchange of eligible quality non-food goods, but the current statutory exclusion list covers technically complex household goods with a warranty of at least one year. A phone may fall within that exclusion. Check the product documentation and warranty before making a claim.

A physical-store purchase: why the general 14-day rule may not apply

Article 25 of the Consumer Protection Law provides a 14-day exchange route for an eligible non-food item that does not suit the consumer by form, dimensions, style, colour, size or configuration. The day of purchase is not counted. The rule is an exchange rule first; a refund may follow where no suitable equivalent is available.

That provision has exceptions. Under the current list approved by Government Resolution No. 2463, technically complex household goods with a warranty period of at least one year are not subject to this quality-goods exchange route. The correct result for a specific phone therefore cannot be inferred from its name alone: the product category and warranty conditions matter.

If the phone has a defect, the legal route is different

A defect is not the same as a change of mind. Article 18 contains separate remedies for defective goods. For a technically complex item, the statute provides an initial 15-day period from transfer for the consumer to seek termination and a refund or replacement; after that, the law identifies specific circumstances in which those demands may still be available. The facts, proof and requested remedy should be assessed separately.

Online and store purchases are not the same

If the phone was ordered remotely, Article 26.1 applies instead of the ordinary in-store exchange rule. As of the date of this guide, a consumer may withdraw before delivery and, after delivery, generally within seven days; when the mandatory written return information was not given at delivery, the period can be longer. Remote-sale rules should be checked for the actual order and delivery documents.

Practical steps before contacting the seller

  1. Confirm whether the purchase was made in a physical store or remotely.
  2. Check the warranty documents, model information and whether the phone is covered by the statutory exclusion list.
  3. If there is a defect, record it and use the defective-goods route rather than a “did not like it” request.
  4. Keep the receipt, order documents, warranty card and correspondence; other proof of purchase can also matter.
  5. Make a written request that clearly states the facts and the legal remedy sought.
